The High Court of Justice of Murcia has ruled in favor of the SIME steward of the City of San Pedro del Pinatar that was moved from his job in retaliation for their union activity.
The facts date back to the last municipal elections in the city of San Pedro del Pinatar in 2011, when, immediately after forming the new government team winning party (PP), moves to this union delegate his job to another department, specifically the computer, almost without warning, and a post without defined functions exist.
According to the new corporation, the transfer occurs because there is shortage of staff in the department, which has proven to be true, and that the real reason the move is due to a reprisal new administration for union activity of this delegate, who was also a member of the Personnel Board.
Thus, the High Court of Justice of Murcia vindicates the union delegate, saying it can not find another explanation logical and reasonable to transfer than linking this person with the union to which he belongs.
